Does Redfin catch all trustee sale in this region?

If the trustee sale is listed in MRIS it will appear on our site.

 

A trustee sale is different from a regular sale because a trustee has been appointed by a court to handle the negotiations and is the individual responsible for the sale despite not owning the property. The trustee has a fiduciary responsibility to represent the interests of the individual or estate whose propertry is being sold.

What makes you say that? The vast majority of properties for sale are listed with a real estate agent who than puts the property into MRIS. Any trustee appointed to sell a property will advertise it and MRIS are the go to place in the local market place.

Are we talking about the same thing here? I feel that you are talking about REOs and I am talking about court order trustee sale conducted at courthouse steps. 

 

Of course, regardless which sale it is, I do not see much benefit in either auction sale or REOs nowadays. Year 2009's opportunities seem to be gone forever.

I've seen a few trustee sales but all were listed in MRIS. One was a divorce, another was the result of someone being put into nursing care and the assets being sold to pay for said care. I've never heard of trustee sales being conducted at the courthouse steps, but just because I haven't heard of it doesn't mean it doesn't happen.

Isn't a "trustee sale" as you use it in "court order trustee sale conducted at courthouse steps" the process by which a bank forecloses upon a property? If so, then of course not of all those sales are on Redfin, though they do seem to pick up some via their "public records" data vendor.

A trustee sale is not necessarily conducted at the courthouse steps. A foreclosure auction is conducted at the courthouse steps and in a deed of trust state like Maryland does involve a trustee but this is not what I thought was being referred to. I think we may all be reffering to different things here.

 

The type of trustee sale I am talking about is when due to a divorce, lack of mental capacity, illness, death or some other circumstance a residential real property owned by an individual or a corporation is being sold by a trustee on behalf of that individual or their estate. In such cases the trustees will often find a real estate agent to list and market the property and will than negotiate the terms of the offers brought to them by that agent. Redfin will have these listings and the agents providing these will usually leave either a public or an agent only remark stating that the sale is a trustee sale because response times from the trustee are usually slower than from a regular seller. The only real difference between this kind of trustee sale and a regular sale is in the disclosures provided. Because the trustee has not occupied the property and cannot reasonably be thought to have extensive knowledge of the property's systems or condition they will provide a disclaimer stating such instead of providing all of their material knowledge via disclosures like an owner who has occupied the property is required to.
