Short Sale Sucess? Anyone close escrow? Tips?

Has anyone had any luck being a buyer on a short sale?  How long did it take to close escrow?  What did you or your agent do?

We're close to closing on a REO, so not quite a short sale. But, knowing what I know now I'd recommend hiring a real estate attorney if you haven't already. Yes they cost $$$, but you can be sure that they'll be your advocate from start to finish. And that they'll help you navigate a potential minefield.

 

Your sellers agent might start to feel more loyal to closing the deal rather than supporting you as the closing day -- and that finish line -- approaches.

for our edification, please tell us more about your process buying the REO with a real estate attorney.  besides pushing things along (phone calls?) what exactly did he/she do for you?  thanks!

Hi Anon-- I didn't have an attorney but I wish I did. My original closing date was tomorrow but the seller still needed to make repairs to the flooring (something that was agreed to in writing). As the date was approaching I'm concerned the seller is going to do a sloppy job with the "repair" and just put a band-aid on it.
 The point: as the closing day approached, I was feeling pressure from my own agent to keep the day. Maybe it was for my own good, maybe not. 
 Now, there probably are some downsides to having an attorney. They might phrase contracts to protect you, but it'll spook the other party.,,

OMG!  Been waiting since Jan. for the bank to say yes or no on our offer.  Apparently, no one cares, eventhough the homeowners haven't paid mortgage for over 1 1/2 years.  We are renting, awesome credit, and have money (50% to put down)...one would think the bank would be anxious to sell it to us.  But noooooo, we're still waiting. The whole shortsale thing, sucks!!!  Good luck!

We are ready to pack it in! Bid on a short sale in March. Here we are the end of July still waiting for the bank to give us the thumbs up. They have postponed four different times since the offer was submitted. Does California want to clear their books of bad debt or not?????

We successfully closed on a short sale late Jan of 2009.  It took 3 months (put offer in early Nov) but the house had already been through 2 different offers that fell through so it had been in the system a long time - about 1 year (a good sign for a new short sale buyer - bank highly motivated to take a loss to move it).  We went with the listing agent of the house we wanted who is also happened to be a real estate attorney and a very nice man, very responsible, who I highly recommend.  Jay Kaplan of Kaplan and Associates here in Palos Verdes.  Tell him Shannon and Suzanne recommended you (we get nothing for the recommendation).  I also recommend Julie Aragon for brokerage - who is the mortgage broker we used (again just a tip - we get nothing for the rec).  She was our miracle worker.  I recommend going with listing agent for all REO or short sale properties that you really really want.  It helps keep things moving.  You can still get your credits and the agent doesn't appear to feel any great loyalty to some large anonymous bank that essentially owns all those REO and short sale props (even though yes I know the short sales aren't yet bank owned but current owner gets no money from the deal so again, no big loyalty there for the listing agent).  Anyway, we got the property for a bit more than half what it sold for in 06.  We had to replace roof, remodel bathroom and redo all floors and paint in and out and landscape ourselves.  It was a mess of a property.  but a great deal.  GOOD LUCK!!

just one more thing.  I recommend that you don't expect any credits or repairs to be followed through with for any REO or short sale properties.   It is NOT likely to happen.  Bank would rather sell to an easy-going buyer for less of a purchase price and for less down than make a few small repairs for a lot more money and more down.  Doesn't make a bit of financial sense but they just want an EASY clean deal.  ask for nothing.  we put 3% down and made all repairs ourselves BEFORE lender would agree to lend on the prop (long story).  It's just a whole different world this time.  Don't ask for any credits or repairs or concessions of any kind if you actually have your heart set on the property.  It is all AS-IS.  truly.  We had some promises (like all old furniture, trash, gross fridge would be removed at closing but nope we had to pay to get all that removed ourselves - which was the least of our troubles.)  think clean clean easy-beasy offer.

Waited almost 4months after we had put in the offer on a shortsale property to get an answer from the bank...but was worth the wait.  Even thought the bank countered our orgininal offer, we countered back with what we wanted and got the house.  Escrow took 1month...only because our agent was on top of it every minute of the day.  In this market, it's so important to have an agent that is experienced and professional in every way, and ours was awesome.  Don't hire family or your friends...it may sound harsh, but hire the one who knows the market and have experience with lots of shortsales and forclosures.  It will make the process so much easier and you'll get the house you want!  Hope this helps.
