9A Report in L.A. City and unpermitted Garage   [ Edited ]

Normally, who is responsible for such filing such report? If it is buyer responsibility, how much it costs to file and what is the time length to get a response from the city? Finally and more importantly, what is the likelihood that the City inspector would requests the Buyer/Seller to convert the unpermitted garage back from doing a 9A report?

Thanks for asking this question.

 

I would love to see a good answer for this. Considering at least half (I know it's really most) the homes I've seen listed and have looked at have plenty of unpermitted additions, I be interested in the real risk. I always assumed un permitted work on a home for sale was "buyer beware" and you'd be on the hook to undo the unpermitted work, and pay for the permits, and fines on top of it. In other words spend tens of thousands to undo permit and then redo the unpermitted work. Perhaps the LA housing market has turned me into a pessimist, or maybe I'm just bitter because I am renting.

 

 Seems like if the city is hurting for cash they could create a few jobs for people to search the MLS for all these unpermitted homes, hire a new county inspector, and then make all these pseudo wealthy ATM home owners pay up. I think it would generate more short term revenue than hiking parking ticket fees another 25% (yes I got a new one yesterday!).

I work for the City, and although I'm not familiar with a 9A report (maybe you're referring to what we call a "Notice to Comply"?), I can tell you that Dvoid is absolutely correct. The City is in economic crisis right now and I know that Building and Safety is cracking down on illegal housing units and unpermitted work. Depending on what kind of job the contractor did, either it will meet the code or it won't. If not, you will either need to restore the house to what is on the books at the City, repair and bring the work up to code, OR possibly apply for a variance (if you're dealing with setbacks and encroachment issues). So, bottom line is: caveat emptor - buy beware - of unpermitted work. Some realtors will downplay it, but it could cold you thousands and a lot of aggravation in the end.

You can file a report with the City of LA here: http://cris.lacity.org/cris/informationcenter/code/index.htm

 

I sent in a report on a house several months ago. Within about a month a city inspector went to the house and verified what I had put in the report and a notice to comply was issued to the owner. Then the owner has time to get the required work done... The entire process was about five months long.
