Mandated repairs by owner prior to home sale in Chicago

Exactly what do city building codes and other laws and regulations mandate that a home owner repair prior to a sale of a home in the city of Chicago?

I am helping my elderly mother prepare her home for sale. The home is probably at least 50 years old and has not had any significant upgrades. She does not wish to do repairs that are only to increase the selling price. She is willing to consider repairs mandated as the home owner's responsibility.

Hi Leonardhc,

 

It has been my experience that there is very little that city building codes require to be repaired in order to sell the home.  In most cases, the city is not aware of the interior condition of the property as they have not had their inspectors inside the home.

 

It should be noted that your home will likely be inspected by a professional home inspector during the attorney review period should you accept a contract. This professional inspector will point out potential code violations, safety issues and general maintenence issues with the home.  The purchaser could seek to have those repairs made by the seller or ask for a credit for those issues.

 

If you would like to have pre-listing inspection, I can refer you to someone who will perform the inspection for free when you make a tax deductible donation to one of his preferred charities that supports wounded soldiers.

Many municipalities require a home inspection prior to the transfer of deed. If they mandate that repairs have to be done, they won't let the deed be recorded until they have proof. One option might be to set money from the closing aside into an escrow account for the repairs, but I am not certain as to whether or not Chicago would allow this.

Thanks, That helps.

 

At this time my mother's preference would be to give the purchaser credit.

 

Should she change her mind, unlikely at this point, or circumstances change, I'll contact you about a referral to an inspector.

Hi Brad,

Thanks. Your reply clarifies the specifics of my question:

Is Chicago one of the municipalities that requires home inspection prior to the transfer of deed?

If it is, do they require any repairs be done before allowing the deed to be recorded?

You may have partially clarified one part of my concern. A municipality may not care whether the seller or buyer does the repairs, just that there be proof that the repairs are done prior to the recording of the deed.

Do you know whom I might contact to find an answer? This seems like such a basic question that an answer should be readily available.
